child lock engaged. the other was burned so badly they couldn't tell for sure but a video of the limousine passing through sfo shows passengers opening it from the inside but neither that video nor another from a camera at the san mateo bridge toll plaza showed anything abnormal. >> some tragedies are crimes and some are not. this one is not. and hence there will be not be any criminal charges. >> reporter: according to the california highway patrol, the driver faces no charges but the owner of the limousine company faces a $7,500 fine. a general citation will be issued for failing to operate safely and having two more passengers in the compartment than there were seat belts. >> reporter: the san mateo county coroner was also at this press conference about the investigation and he said that his investigation revealed that the cause of death was smoke inhalation for those five

victims. i asked him a question a lot of folks have posed to me over the last months and it must have been a horrible death. did they suffer? he said based on what he found on the bodies of the victims, their death was very quick. >> thank you. we first interviewed the driver of that limo soon after the crash. today we sat down with him again. orville ricky brown spoke with us in vallejo today with his brother and father by his side. brown again said he did everything he could to get the women out of the burning limo. last month you might recall his estranged wife claims they were arguing before the disaster. he said dealing with that allegation was stressful. >> i was there, okay. i knew i wasn't on the phone. it's painful when you have to re-occur. did i call her five minutes

before or ten minutes before. it was a long time ago. a lot of things have occurred. >> since the accident in may he has been getting therapy and volunteering with with nonprofits and says he could face civil suits but will do fundraisers to raise money for the victims' family. police are asking for the public's help in finding a man that hit and killed a man in the south bay. nbc bay area's marianne favro is near the scene. police are investigating a second hit-and-run in the same area. >> reporter: they are trying to determine if the two cases are linked. carlton ford was killed here on allen rock avenue on saturday night and now chp needs your help finding the driver and tonight they have much more detail about the suspect vehicle. today a chp investigator talked to neighbors to try to find the

driver who hit a man and then drove off here in san jose. the victim was walking near harriet avenue saturday night when witnesses say a truck slammed into him, killing him. >> he was a 61-year-old gentleman, carlton ford. he was transported to regional medical center where he was pronounced deceased that evening after the collision. >> reporter: investigators describe the suspect's vehicle as a 1990s ford truck tan or white with oversized tires. the truck had a red stripe on the hood and a damaged front headlight. witnesses say the victim lived in the neighborhood and that carlton ford walked with his cane to the library almost every day. >> he was very nice and he waved and always said hi. >> reporter: chp officers say the night before there was another hit-and-run three blocks away. the suspect's vehicle in that case was also a truck. >> a trailer came dislodged from

the truck and started to roll backwards and collided with a gentleman that was in the area who sustained major injuries. >> reporter: officers say they don't know if the truck is the same one that hit ford but they are looking into the possibility. in the meantime, neighbors are now calling for safety improvements including better lighting and more crosswalks. changes they hope will prevent another tragedy here. and tonight some neighbors are also calling for more traffic signals to be installed here to get more people to slow down. reporting live in san jose, marianne favro, nbc bay area news. it is a lethal combination. dry weather and lightning. firefighters are already battling nine major wildfires throughout the state. the national weather service says issued a red flag warning for the foothills and mountains of northern california. cal fire has increased staffing and not just lightning. the hot and humid weather we're experiencing might also produce some rare summer thunderstorms.

let's bring in our chief meteorologist jeff ranieri to explain what's happening here. >> it's wild and bizarre. something that should not be happening this time of year. the key component to that wacky weather is that humidity that's pushing up from the south. you can see we have arrows positioned from the south to the north and slightly out to the west. that's the circulation around this area of low pressure that's bringing up this moisture. we'll talk more about those thunderstorms in a second. let's get to this uncomfortable air in the east bay. not only hot but humid. 102 in livermore. 100 in walnut creek. feeling like 104 to 106 when you factor in humidity. you have hot air and isolated lightning that's already being produ produced. i do think as we head throughout tuesday's forecast the worst conditions will likely be in the north and also the east bay and hills above 1,000 feet where temperatures will be in the 90s and we'll also have that possibility of lightning in the forecast. you can see here on doppler

radar offshore, not only a few dozen but hundreds of lightning strikes over the past 30 to 45 minutes. we'll track more of this and let you know how long the lightning threat will last in a few minutes. it's not just california. dozens of wildfires are raging across the west from pacific coast to colorado. a fire sparked by lightning has been burning out of control in central idaho for the past 11 days. it has forced more than 2,000 families out of their homes. near the resort community of sun valley where celebrities including tom hanks, bruce willis and arnold schwarzenegger own multimillion dollar homes. more evacuations could come before firefighters get a handle on this inferno. nbc's jay gray joins us live with the latest on this devastating fire. jay? >> reporter: just a rough go. conditions not really giving firefighters a break. the wind kicking up here and has throughout the afternoon. take a look. you can see fresh smoke over this burned out hill here. they are still actively pursuing this blaze and will be for quite

some time. now, this area burned out on the edge of town part of more than 100,000 acres destroyed by the beaver creek blaze. that number expected to go up overnight. not just here but across the region. a huge section of the western united states is on fire right now. at least 34 wildfires are raging in 11 states scorching 800,000 acres and growing. the most severe continues to be the beaver creek fire which has forced more than 2,000 from their homes and now threatens another 8,000 structures or more in the mountains of central idaho. >> it's really terrifying because this is the most -- biggest fire in america they said. >> reporter: and the biggest response. around 1,200 firefighters in the air and along the front lines on the ground but to this point that show of force has not been enough to contain the blaze

pushed by winds gusting to 30 miles an hour. >> one of the most important things for us to watch out for are spots, embers that can be ahead of the main fire thrown ahead of the main fire and create new areas that will burn. >> reporter: crews and this community using every weapon they can in another desperate fight. though the battle here is still clearly far from over. when you see all of the devastation here, it really makes you appreciate what these fire teams have done as far as protection is concerned. during the 12-day span they've been fighting this blaze, only one house completely swallowed by the flames. that's the latest live here in idaho. i'm jay gray, nbc bay area news. >> along the fire lines there in idaho. thank you. the san francisco fire department is debating a hot button issuing that bans firefighters from using helmet cams in the field. the review comes after a video

from a battalion chief's helmet camera captured a fire truck fatally running over a young woman during the asiana plane crash at sfo. they say a policy forbids firefighters from making video recordings in the field without permission. he said videos could violate patient's privacy rights. a fire department spokesperson says the department is reviewing the policy but for now the policy remains in effect. >> we need to maintain a certain amount of control over video recordings and that sort of thing in order to protect the intent of the original policy, which is privacy. that is the main issue. >> she says there's no time frame for this review. an attorney for the family of the girl that was killed by the fire truck has criticized the policy saying the videos could help public safety. a federal judge has given state prison officials permission to force feed certain inmates who are participating in a hunger strike. state officials fear for the

a bill allows transgender facilities to use the restrooms that correspond with their identity instead of biological gender. they are working to put a measure on the state ballot that would overturn the new law. they want the bill overturned because of concern for the impact on the rest of the students. the suspect in a bizarre attack at a san francisco b.a.r.t. station is fighting charges against him. investigators say a trained ee acrobat with an through the b.a.r.t. station grabbing several people and kicking a

b.a.r.t. employee on may 10th. today he plead not guilty to several charges including false imprisonment, battery and sexual battery. he's due back in court next month. a legendary bay area musician attacked during a performance is suing the city of hayward. 73-year-old lester chambers had just dedicated a song to florida shooting victim trayvon martin when a woman jumped on stage and attacked him. he had bruised ribs and a hip injury. this happened on july 13th in hayward. the same day george zimmerman was acquitted in martin's death. chambers say the attack left him badly shaken. >> the last time i had any type of assault, i was 15 years old. in middle school. chambers brothers never, ever, in the entire career ever encountered any type of

violence. >> chambers now stands and walks with the help of a cane expressed disappointment his attacker was not charged with a hate crime. he's suing the city of hayward which sponsored the festival. the music promoter he's suing and managers of the security team. five team from the south bay are under arrest for kidnapping a woman to force her into prostitution. the alleged victim is an 18-year-old woman who escaped on friday and called for help in riverside county. she told deputies she had been kidnapped in the compton area the day before by a woman and four men with a gun. she said she was sexually assaulted by two of her kidnappers. h e moreno valley hotel room.nxy]u2s olympic star oscar pistorius

attended a brief9ud7ááqurt hear were outlined. pistorius admitted shooting steenkamp through a bathroom door at his home in february but says he was acting in self-defense against what he thought was an intruder. today's hearing was on steenkamp's birthday. she would have been 30 years old. a trial date was set for march of next year. it doesn't happen often on local beaches. a whale was stranded on stinson beach. 42 feet long. a pair of young joggers discovered the juvenile fin whale on the beach at 6:30 this morning. they said the whale was still breathing and struggling in the sand. now a crowd of 200 people turned out as the fire department tried to figure out what to do. they summoned biologist from the marine mammal center but the whale died before they could arrive. many of those gathered said they were heartbroken.

>> it made any sad because i know there's a lot of whales out there but she was just a baby and should have had a longer life. >> biologist will try to determine what drove this young whale to shore. the county is planning to dig a pit and bury the whale at the beach. now to our continuing coverage of the america's cup. a lot of drama on the water over the weekend and that's expected to continue during the final few weeks of this event. nbc bay area's lawrence scott is live with the latest. >> reporter: the wind is pretty high right now and earlier this afternoon for the second race it was too high to sail once again. they put in some protocols with wind limits after the fatal crash so that the wind wouldn't be too high and put sailors in jeopardy so now three races in three consecutive days have been postponed which might be a good thing for the italian team which after three race days could be down 6-0 in this competition.

right now it's 2-1 with new zealand leading this competition and you just got to see what's happened these past three days. take a look. now three days into the finals and it's feeling like the plot to the movie "groundhog day." three consecutive days and three similar results. race day one equipment failure while new zealand buries sails while maneuvering but finishing before high wind postponed the second scheduled race of the day. sunday, day two, the stallout with hydraulics problem and it's tied up 1-1. before high wind faces a postponement of the day's second race. now, monday's action in day three, a mirror of the past weekend. issues with the wing sails stalling out and does not finish while new zealand takes a victory in a 2-1 lead before the second race of the day yet again

postponed with the wind limits exceeded. if boats aren't breaking, the winds are too high. here's new zealand's skipper. >> we were worried going into the weekend that it would be a reasonable chance we wouldn't get four races in but we thought by the end of today that we would have caught them up. it's just the time of year in san francisco. crazy time of the year. >> and the crew obviously disappointed with not finishing two-thirds of these initial races in this final series. >> the main problem is the fact that we really start to push out of the boat and unfortunately you only face that when you're really racing and you push it out of the boat against another team. >> reporter: when you think about it, maybe too much wind is something that you can work around better than too little wind back in 2007 in spain when they had the last cup challenger series at the start there was

not enough wind. it took them 11 days to get the thing going. we'll have more racing on wednesday and hopefully the wind will cooperate. let's send it back to you in the studio. >> i'll figure this out soon. >> you are? >> we are getting to be experts slowly but surely. >> it's dramatic. we have a dramatic event on the weather and dramatic stuff going on in our skies. >> we do have a lot happening. so much wind the last couple days because of major hot air in the east bay and cold air in the pacific and you need a huge temperature difference and you get massive wind in the bay area and that's helping to fuel those boats. otherwise right now it's all about this system that's sitting offshore and key component to this bizarre weather the past few days and coming two days is the humidity. it's flooding up from the south. circulation around this area of low pressure offshore and it's also firing up some thunderstorms. you'll be able to see offshore where that doppler radar scans around. not just a couple but hundreds of lightning strikes offshore where we get the most uplift.

that's good news. this poses no threat to us. with lightning strikes that close, we are going to keep that threat here of some lightning in the forecast at least for the next two days and in fact over the past hour 235 strikes to be exact our computer is picking up on. let's get a look at this hot air we've in the east bay. low 90s currently. we've dropped out of the 100s. that's good news. it's still humid. dew points right now in the low 60s. 80 in san jose. 67 in san francisco. 86 in novato. mic microclimate in full effect. throughout tuesday you'll notice a thunderstorm icon for everyone at every day part of the hour. at the coast, by the bay and inland. very scattered in nature but keep your eyes close to the sky kyc&up)qáhjá @(& stray lightning strike and4v)kl have that fire threat elevated and of course they can be deadly so take it easy out there ifft1u do see the lightning+k ck view outside and what you're goinga.,ño find here on
